Important Health & Physical Fitness Disclaimer

Fit JRNL is an information and personal workout tracking tool only. It does not provide medical advice, diagnosis, treatment, or individualized health prescriptions. Always consult a qualified physician or healthcare professional before beginning any physical exercise, strength training program, or dietary regimen. Use of the App is strictly at your own risk.

1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Canon Evnt ("we", "us", or "our") governing your access to and use of the Fit JRNL mobile application ("the App") on Apple iOS and iPadOS platforms.

By downloading, installing, or using Fit JRNL, you agree to be bound by these Terms and Apple's Standard Licensed Application End User License Agreement (EULA). If you do not agree to these Terms, do not install or use the App.

2. License Grant & Permitted Use

Subject to your compliance with these Terms, Canon Evnt grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and execute the App on authorized Apple-branded devices linked to your personal Apple ID account.

You agree that you will not:

  • Decompile, reverse engineer, disassemble, or attempt to derive the source code of the App.
  • Modify, adapt, translate, or create derivative works based upon the App.
  • Distribute, sell, lease, rent, sublicense, or commercially exploit the App without express written authorization.
  • Remove, alter, or obscure any proprietary copyright notices or trademarks within the App.

3. Medical & Fitness Activity Disclaimer

Physical exercise, weight training, and fitness activities carry inherent risks of injury or physical harm. Fit JRNL provides digital journal tools, rest timers, and macro calculations for self-directed personal tracking.

  • Not Medical Advice: No information, calculation (such as 1RM or caloric targets), or metric displayed in the App should be construed as medical, physiological, or nutritional advice.
  • Assumption of Risk: You voluntarily assume full responsibility for any risks, injuries, damages, or health complications resulting from your physical workouts and dietary choices.
  • Emergency Situations: If you experience dizziness, pain, shortness of breath, or medical discomfort during exercise, immediately discontinue the activity and seek emergency medical assistance.

4. User Data & Local Persistence Responsibility

Fit JRNL operates on a local-first architectural model. All workout entries, historical sets, macro nutrition logs, and user preferences are persisted exclusively to your device's sandboxed SwiftData SQLite database.

  • You acknowledge that you are solely responsible for maintaining backups of your iOS device (via Apple iCloud or local iTunes/Finder backups).
  • Canon Evnt maintains zero server-side databases of your personal logs and cannot restore workout data lost due to device damage, uninstallation, or operating system resets.

5. Subscriptions & StoreKit Terms

Fit JRNL offers auto-renewable subscriptions (such as monthly, quarterly, or annual membership plans) processed through Apple In-App Purchases:

  • All financial transactions, billing inquiries, and refunds are managed directly and exclusively by Apple Inc. in accordance with Apple Media Services Terms and Conditions.
  • Subscriptions are tied to your Apple ID, manage auto-renewal settings via your Apple ID Account Settings, and can be restored at any time via the "Restore Purchases" button in the App's settings.

6. Intellectual Property Rights

The App, including but not limited to its user interface designs, custom visual theme engines (Cyber Kinetic, Warm Gold, Laser Magenta), software architecture, brand assets, graphics, and documentation, are the exclusive intellectual property of Canon Evnt and Ryan Yarbrough. All rights not expressly granted herein are reserved.

7. Disclaimer of Warranties

THE APPLICATION IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. CANON EVNT DOES NOT WARRANT THAT THE APPLICATION WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPATIBLE WITH ALL FUTURE IOS RELEASES.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CANON EVNT, ITS FOUNDER, OR AFFILIATES BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OR INABILITY TO USE THE APPLICATION, INCLUDING BUT NOT LIMITED TO PERSONAL INJURY, PROPERTY DAMAGE, LOSS OF DATA, OR WORKOUT INTERRUPTION.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law principles.
